Marketing Studio User Agreement
Effective date: June 15, 2026
This User Agreement governs your use of Marketing Studio, the client portal, and related AI-assisted marketing services operated by Pascoal Dsouza. By creating an account, submitting a request, connecting Meta or Instagram credentials, approving content, or using the portal, you agree to these terms.
1. What Marketing Studio Does
Marketing Studio helps prepare marketing assets such as image posts, captions, hooks, hashtags, SEO notes, schedules, approval queues, notices, and ad request briefs. The system uses AI automation running through the owner-operated backend and personal PC infrastructure. Outputs may be created, queued, reviewed, retried, edited, approved, rejected, scheduled, or published depending on your plan and permissions.
2. Human Review Is Required
AI output can contain mistakes, inaccurate claims, unwanted visuals, spelling issues, brand mismatch, timing errors, or platform-risky content. You are responsible for reviewing and approving content before it is published or used. Auto-approval, if enabled, means you accept the risk of approving ready posts automatically.
3. Account, Login, and API Key
Your account uses your email and a private client API key saved in your browser. Do not share your API key. Anyone with the key may access or act on your client portal data. You must keep your login, browser, Meta credentials, and connected accounts secure.
4. Free Plan Limits
The starter/free plan is a 60-day free trial from the date your account is created. During the trial, it allows one active weekly request at a time, up to 7 image posts for that active weekly batch, and 2 retry submissions per 7-day period. You may be asked to subscribe after the trial ends, before creating additional active requests, increasing volume, downloading retained media, requesting extra automation, or using premium workflows.
5. Requests, Scheduling, and Publishing
You choose the niche, campaign goal, audience, post count, and schedule slots. The system prepares content based on those inputs. Publishing depends on approved content, valid connected platform credentials, platform availability, owner-side backend availability, and third-party API rules. Posting at an exact time is not guaranteed.
6. Meta, Instagram, and Third-Party Platforms
If you connect Meta or Instagram credentials, you confirm that you own or are authorized to manage those accounts. Third-party platforms may reject content, expire tokens, change rules, throttle requests, or suspend access. Marketing Studio is not responsible for platform decisions, outages, policy changes, or account restrictions.
7. Generated Content and Rights
You may use approved generated content for your business, subject to payment status, platform rules, and applicable law. You are responsible for ensuring that your business claims, offers, prices, testimonials, regulated-industry statements, and brand materials are accurate and lawful.
8. Prohibited Use
- Do not submit illegal, deceptive, hateful, sexual, exploitative, infringing, or harmful requests.
- Do not request impersonation, fake endorsements, fake credentials, misleading offers, or unlawful targeting.
- Do not upload or request use of content you do not have rights to use.
- Do not attempt to bypass plan limits, security checks, API keys, or approval gates.
9. Deletion and Data Loss
The Settings page includes a Delete Account option. If you confirm deletion, Marketing Studio will remove your local client account data, requests, generated posts, approvals, schedules, notices, stored credentials, Growth Ads requests, and generated media stored for that account. This action is intended to be permanent and may not be recoverable.
10. Availability and Personal PC Backend
Marketing Studio may depend on the owner-operated backend, local machine, network tunnel, API quotas, third-party services, and scheduled jobs. Because parts of the system run through a personal PC/backend setup, uptime is not guaranteed. The service may be interrupted for maintenance, internet issues, power issues, software updates, quota limits, or platform outages.
11. Payments and Subscriptions
Paid features, higher limits, downloads, premium automation, or ad workflows may require a subscription or separate agreement. Fees, refunds, deliverables, cancellation, and paid-service terms may be covered by a separate service agreement or invoice.
12. Privacy
Data handling is described in the Privacy Policy. By using the service, you consent to the collection and use of account, request, generated-content, credential, schedule, notice, and usage data needed to operate the portal.
13. No Guaranteed Results
Marketing Studio does not guarantee followers, views, engagement, leads, sales, ad approvals, rankings, reach, conversions, or account growth. Results depend on your offer, market, audience, budget, platforms, approvals, consistency, and external conditions.
14. Liability
Use the service at your own risk. To the maximum extent allowed by law, Marketing Studio and its operator are not liable for indirect, incidental, consequential, special, punitive, business-interruption, lost-profit, platform-account, or data-loss damages.
15. Changes
These terms may be updated as the service changes. Continued use after changes means you accept the updated terms.
